These are the terms and conditions relating to the sale, offering for sale of products by Smile Equestrian.

Smile Equestrian is a trading name of Seremar Limited.

By using, accessing, attempting to access, browsing the site www.smileequestrian.co.uk you acknowledge that you have read, understood and agree to these terms and conditions for use of the site. Furthermore you agree to abide by and agree to be bound by these terms and conditions and to agree to comply with all laws and regulations pertinent to such use of the site. By using the web site you are also agreeing to receiving communications from Smile Equestrian that will relate purely to either your account, ordering process, purchases or disputes arising. This communication will be in the form of e-mail, letter or telephone contact. Smile Equestrian will not pass on your personal details or e-mail details to any third parties unless those parties are UK or European law enforcement agencies supported by legislation or court orders. We also reserve the right to pass on your details whereby Smile Equestrian has become a victim of crime resultant from your direct use of the site.

Smile equestrian and it's directors offers the use of this web site on a 'as seen' and 'as is' basis and makes no representations or warranties whatsoever with respect to it or its contents and disclaims all such representations and warranties to the fullest extent permitted under English Law. Smile Equestrian or any directors of the company will not accept liability for damages of any kind arising out of, or in connection with, the use of this website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and any claims of or by third parties. If there is any breach by the users of the Smile Equestrian web site of the terms and conditions of use and we take no action this is not a waiver of any breach and we reserve the right to take any appropriate action at a later date to rectify/remedy any such breach.

We reserve the right to alter, remove or amend any of the web site content without notice and the same applies to the terms and conditions, returns policy and refund policy.

All goods and transactions on the Smile Equestrian Web site are sold under the laws and regulations applicable to England and Wales.

All the content of the Smile equestrian Web site is owned legally and beneficially, including the intellectual property rights by Smile Equestrian Limited and this includes all text, design and graphics and images. Some images are re-produced with consent or implied consent of the copyright owners.

Smile Equestrian will not be held responsible or accept any liability for our failure to comply with our obligations in respect of any of the above resultant from any event that is/was beyond our reasonable control.

Pricing Policy  

All the prices shown are inclusive of vat unless otherwise stated and are shown in Pounds Sterling. Whilst every effort is made to ensure that all products are priced correctly, accept that mistakes can be made from time to time. If during any process we establish or are advised that a product has been incorrectly priced or sold at a price higher than the site advertises the product for then a refund of the difference will be made. We never advertise or guarantee that our prices are the lowest available and our prices for each individual item is assessed and set purely dependant upon the price we can obtain the goods for from our suppliers. These prices can change on products for a variety of reasons and we cannot be held liable for market fluctuations in the supply of goods to us. We reserve the right to alter, amend the price of any product listed on the site but this will not affect any orders already being processed for a product. The price you pay for a product is the price displayed when you placed your order. Delivery charges for products are extra and are advised at the time of ordering. If there is no delivery charge levied you will be advised of this. Smile Equestrian reserve the right to discount the price of any goods at any time. All pricing and delivery is based upon sale and delivery to mainland UK addresses and we request overseas purchasers to contact us in the first instance to ascertain if we will supply the goods to that country, we reserve the right not to sell or enter into any contract with any person or company or to terminate that contract without reason. If a customer places an order on line we reserve the right without reason to refund their monies and cancel the contract of sale. We will not be held liable for any losses involved or expenses incurred by purchasers or any consequential losses that may result from this occurring.   

Delivery  

All goods ordered will be despatched under normal circumstances, if in stock, within 36 hours of the order placement. If we can process and despatch an order the same day as order placement this will be done. If any item is not available from stock you will be advised either on ordering or within 36 hours. Goods ordered can be paid for by the Paypal secure system and will be despatched as per the above. Goods paid for by cheque will only be despatched upon the cheque clearance into our account. All orders must be paid for prior to despatch unless we have advised you otherwise in writing.

Delivery will be made to the delivery address provided by the customer and advised to us during the ordering process. Please ensure that the delivery address supplied to Smile Equestrian is accurate and is an address that Royal Mail will deliver to, this is the responsibility of the purchaser on ordering goods. We will not be held responsible for any goods that have been delivered to an incorrectly advised address. Once ordered goods have been delivered to you or your nominated recipient, we will not be liable for their subsequent theft, loss, damage or destruction. Please allow up to 10 working days for delivery. We offer no guarantee of availability and this electronic publication www.smileequestrian.co.uk does not constitute an offer for sale.

Our returns policy is shown on this site and the only variance in the contract of sale is with regard to items sold that are personalised or specialised, wheel clamps or hitch locks that are supplied with high security keys, DVD’s, CD’s and software. These items will be accepted for return at our discretion (unless faulty) and with regard to wheel clamps and hitch locks the original delivery costs paid may not be refunded by us.

If an item is returned and is part of a multiple item order then any part delivery cost refund from the original purchase will be at our discretion.

Warranty and guarantee of any item is provided for as the merchandiser but in some instances this may be deferred to the manufacturer in certain cases for a repair, examination, or replacement at their discretion.

Delivery prices advised within the site are for delivery only by Royal Mail to any UK mainland address. Orders for delivery to addresses in Eire or the European Union will be accepted but an extra charge for delivery will be made and you should contact us for a quote prior to placing an order. We will then require acceptance via e-mail of the delivery price quoted before accepting the order placement. If an error is made on a postal price due to a change in Royal Mail pricing or delivery policy we will notify you of this if we plan to request an extra delivery payment. You will be given at this time the option to cancel your order without suffering any financial penalty.
